Smoke Free Places Act

Posted by The Vapour Trail at

As of June 1st,2015 we will not be able to allow testing or vaping in any of our stores. This is the result of new legislation introduced and below is information regarding the consequences if caught vaping indoors.

Customer
If it is a customer (someone other than a manager/employer), the officer can either issue a Summary Offence Ticket on the spot or lay a charge requiring a court appearance. The amount of the Summary Offence Ticket for out of court settlement is $406.45. Here is the link:

http://www.novascotia.ca/…/reg…/regs/sot-schedules/sp-23.htm

If the individual is required to appear in court, the maximum amounts are the following and the amount paid is determined by the judge:

14 (1) Every person, other than a manager or employer, who contravenes this Act or the regulations or fails to comply with an order made pursuant to this Act or the regulations is guilty of an offence and liable on summary conviction to a fine of not more than two thousand dollars.

Manager/Employer
The manager or employer of the venue can also be charged. There is not a Summary Offence Ticket option for this. Instead it goes to a court. The maximum amounts are the following and the amount paid is determined by the judge.

14 (2) Every manager or employer who contravenes this Act or the regulations or fails to comply with an order made pursuant to this Act or the regulations is guilty of an offence and liable on summary conviction for a first offence to a fine of not more than two thousand dollars, for a second offence to a fine of not more than five thousand dollars and for a third or subsequent offence to a fine of not more than ten thousand dollars.

The two sections above (14-1 and 14-2) are part of the Smoke Free Places Act at this link in section 14: http://nslegislature.ca/legc/statutes/smokfree.htm Note that this online version hasn’t been updated yet to include the changes that were added in the fall (e.g. definition of e-cigarette) but the fine section applies.

This page contains Schedule 23 to the Summary Offence Tickets Regulations.
